Talaq(Divorce) by Husband in Muslim Law

There is Two types of talak

1.Talaq-ul-sunnat

2.Talaq-ul-biddat(Tripple talaq)

Firstly we will Discuss Talaq-uL-Sunnat

Talaq-ul-sunnat is of Two types:-

1.Hasan Talaq

2.Ahsan Talaq

Hasan Talaq:-

In Arabic the term Hasan means good or proper and Wilson translate it has proper divorce. To be in Hasan form the following proceeding must be satisfied in the following condition:-

  1. The divorce will be pronounce in the successive pronouncement
  2. If the wife is on their mensuration period divorce has to be pronounced in the period of purity.
  3. If the wife is not menstruating the period of purity (Tuhr) became a relevant the divorce will be pronounced after the period of thirty day of the  successive months

Revocability:- No sexual intercourse should take place in the period of the Tuhr.

 Ahsan talaq:- in Arabic the word  ahsan means best and proper form of the Talaq to be in the form of the ahsan, the following proceeding must take place:-

  1. The husband must pronounce the formula of the divorce in a single sentence
  2. The pronouncement must be in the period of purity (Tuhr:-is a period when the women is free from her menstrual cycle.
  3. The husband must abstain him self from sexual intercourse till the period of iddat, in case of unconsummated marriage the pronouncement can be done in the menstrual cycle
  4.   If the husband lives far away and even if the marriage consummated divorce can be pronounced in the respective of the tuhr.

Revocability:-  It can be revoke during the period of the iddat, the revocation can be express or implied.
