Judicial divorce

Grounds of divorce (Judicial divorce) for Muslim wives-:

1. The husband has been absent from the marital home for a period of four years. (Here the decree that will be passed by the court, will be effective only after the completion of six months of the decree.

2 .If the husband is unable to maintain his wife for a period of two years.

3. If the husband is under imprisonment for a period of seven years.

4. If the husband is suffering from insanity for a period of two years.

5. If the husband has treating  her with cruelty.

6.  Married before attain the age of puberty as per Muslim law after the become major she have the option to repudiate the marriage judicially. (The parties can approach to the court repudiation of her marriage by means provided by Mohammedan law.
